Standing Up for Our Daughters and Protecting Girls’ Sports

Do you think girls’ locker rooms should be for girls? That boys should compete against boys in High School and College sports? Yes? Well, most Americans agree with you. And just in time for Independence Day, New York parents got a gift from a most unlikely place—a Judge in Kansas. 

In the case State of Kansas v. United States Department of Education, a federal District court granted an injunction to the plaintiffs that prevents the Biden Administration from implementing their radical gender ideology changes to the Title IX law meant to protect girls’ sports. And because one of the plaintiffs is the national organization Moms for Liberty–the school of any child of a Moms for Liberty member is covered by that injunction. 

Title IX was enacted in 1972 and prohibits sex-based discrimination in any institution that receives federal funding. For half a century its guarantees of equal protection to female athletes helped grow girls’ sports across the country.  The Biden administration decided to undermine those guarantees with a radical rewrite of Title IX that replaces the real category of “sex” with the invented category of “gender identity.” And that rewrite–set to go in effect on August 1, 2024– would allow men to play in women’s sports, boys to change in girls’ locker rooms, and crush the hopes and dreams of many young female athletes. 

There are several court cases from Attorneys General in different states and brave parents that are standing up for their daughters all across the country trying to stop this injustice, but the case out of Kansas offers immediate relief for parents anywhere in the country. Here’s why. The case says,

Accordingly, it is hereby ordered that the United States Department of Education, Miguel Cardona, Secretary of U.S. Dept. of Education, the United States Department of Justice, Merrick Garland, Attorney General of the United States, and all their respective officers, agents, employees, attorneys, and persons acting in concert or participation with them are ENJOINED from implementing, enacting, enforcing, or taking any action to enforce the Final Rule promulgated by the Department of Education titled “Nondiscrimination on the Basis of Sex in Education Programs or Activities Receiving Federal Financial Assistance” and published in the Federal Register at 89 Fed. Reg. 33,474, set to become effective on August 1, 2024, against Kansas, Alaska, Utah, Wyoming, K.R.’s school, the schools attended by the members of Young America’s Foundation or Female Athletes United, as well as the schools attended by the children of the members of Moms for Liberty. Plaintiff Organizations are directed to file a notice in the record identifying the schools which their members or their members’ children, as applicable, attend on or before July 15, 2024.8 IT IS SO ORDERED. Dated this 2nd day of July, 2024.

Our daughters deserve the same protections that so many of us grew up with in this great country. The right to play sports with and against other girls, and the right to say, “I don’t want to change my clothes in front of that man.” That’s not a lot to ask for and it is certainly worth fighting for.
