Fadiel Adams Remanded Until May 13 Over Fraud and Obstruction Charges Linked to Magaqa Case

Fadiel Adams, leader of the National Coloured Congress, will remain in custody until May 13th after appearing before the Pinetown Magistrate’s Court in KwaZulu-Natal on Thursday. The Member of Parliament faces five charges, including three counts of fraud and two counts of defeating the ends of justice.

Authorities arrested Adams in Cape Town on Tuesday before transferring him to Durban. The charges stem from allegations that he interfered in the 2017 murder investigation of former ANC Youth League secretary-general Sindiso Magaqa. Prosecutors allege that Adams visited Magaqa’s convicted killer, Sibusiso Ncengwa, while he was in custody at the Westville Correctional Facility during ongoing legal proceedings.

The State opposed bail, arguing that Adams had shown defiant conduct and raised concerns about his interactions with the justice system. Prosecutors also questioned inconsistencies around his address and cited remarks made during public statements. “If the State did not oppose, it would be a dereliction of duties,” the prosecution stated, adding that Adams’ comments had contributed to concerns that he may not fully comply with court processes. They further pointed to his public declarations, including remarks interpreted as suggesting evasion of law enforcement.

Adams’ lawyer, Bruce Hendricks, opposed the postponement, saying the defence had repeatedly sought confirmation of the warrant. He said Adams had approached authorities for clarification and secured a High Court order compelling police to release relevant documents. Hendricks also submitted proof of residence, including a title deed, and noted that Adams has no prior convictions or pending cases. He added that Adams has minor children and should not remain in custody ahead of a bail hearing.

The court ultimately granted the State’s request for a postponement, allowing time to prepare for the formal bail application. The matter will return to court on May 13th.
